Party Wall - Seeking the advice of an checking / advising engineer

Section 10(12) of the Party Wall etc. Act 1996 allows an adjoining owner to seek the services of an "advising engineer or other consultant as may be necessary" to assist them in understanding the proposed works and their potential impact on their property.

This section states that "an adjoining owner may, at his own expense, employ any surveyor, engineer or architect or other person having the necessary qualifications to advise him on any matter relating to the exercise of the rights and obligations conferred or imposed on him by or under this Act."

Therefore, if you are an adjoining owner and you require the services of an advising engineer or other consultant to help you understand the proposed works and their potential impact on your property, you are entitled to do so at the building owners expense under Section 10(12) of the Party Wall etc. Act 1996.

However, the works must be seen as complex to such an extent that it outside the expertise of your appointed surveyor.
