Mayfair is a particularly interesting area when it comes to carrying out Party Wall surveys. There are so many varied situations regarding flying freeholds, head leases, subleases, commercials and long and short assured tenancies. Therefore, it's important that all parties are notified under the Party Wall act of 1996.
It's not always possible to identify all the parties through the land registry website alone. Therefore, I will normally visit the site and determine how many parties are likely to be affected by the works. This helps in getting the notices right first time around, which helps prevent delays to the project. It also helps identify areas where building works access is going to be required, and any enclosure costs.
In this particular project that I was involved in. I managed to get appointed as the Agreed Sole Surveyor for over 50% of the Adjoining Owners which saved the Building Owner £££.., thousands of pounds. It helps the project enormously; when people can quickly obtain confidence that the Agreed Surveyor can act impartial and act with integrity and transparency. It is good to have this one trusted conduit between neighbours when they are carrying out building works with each other. I get a lot of repeat business because of this very reason.
I often get asked by Adjoining Owners, how can you remain impartial and act with transparency when the Building Owner is paying your fees. I firstly say that I am carrying out a statutory role and secondly, I sit on both the Professional Conduct Disciplinary Boards of the faculty of Party Wall Surveyor's and the Chartered Institute of Building. Over 10 years with the Chartered Institute of building and to a lesser extent with the faculty of party Wall Surveyors. One cannot under estimate the importance of acting with integrity, transparency, fairness and impartially when it comes to dealing with Party Wall matters.
