When Old Works Raise New Questions: Resolving Long-Standing Defects and Disputes

Disputes between neighbours are never straightforward — particularly when they relate to works carried out many years earlier. When time has passed, memories fade, responsibilities blur, and what begins as a technical issue can quickly become a deeply entrenched disagreement.

We were recently instructed to step into exactly this kind of situation.

Picking Up a Complex Case

The matter involved alleged latent damage to an adjoining owner’s property, linked to party wall works undertaken several years ago. We were appointed to take over from a previous surveyor and bring clarity to a situation that had become increasingly strained.

By the time we became involved, positions had hardened.

The adjoining owner was experiencing significant issues within their property, including the presence of dry rot — a serious form of timber decay that can cause extensive structural damage if left unchecked. The blame, however, was firmly being directed at the building owner, with allegations that the earlier works had allowed water to escape into the adjoining property over a prolonged period — reportedly in excess of four years.

Understanding the Real Problem

Our role as Chartered Building Surveyors was to step back and assess the situation objectively.

Dry rot does not occur without cause. It requires sustained moisture, poor ventilation, and the right environmental conditions to develop and spread. The key question, therefore, was not simply what the damage was — but why it had occurred.

We carried out a detailed inspection of the property, reviewing:

• The history of the original party wall works
• The construction and detailing at the boundary
• The current condition of the affected timbers and surrounding structure
• Potential sources of moisture ingress

This was essential in distinguishing between historic works, ongoing maintenance issues, and any potential long-term water escape.

Cause, Responsibility, and Evidence

In disputes of this nature, causation is everything.

Allegations of water escaping over a period of four or more years are significant — but they must be supported by evidence. Establishing whether damage is directly attributable to past building works, or whether it has arisen due to other factors such as maintenance, defects, or environmental conditions, requires careful and impartial analysis.

Our role was not to take sides, but to:

• Identify the likely cause(s) of the dry rot
• Assess whether there was a credible link to the historic works
• Provide clear, professional advice on liability and next steps

The Reality of Long-Term Defects

What became clear is that issues like this rarely have a single, simple cause.

Prolonged moisture exposure can develop gradually, often exacerbated by a combination of factors — minor defects, lack of maintenance, and environmental conditions working together over time. By the point dry rot becomes visible, the underlying problem has usually been present for quite some time.

In this case, extensive remedial works were now required — regardless of how the issue had originated.

Bringing Clarity to a Difficult Situation

Taking over from a previous surveyor also required careful handling.

We needed to reset the tone of the discussions, re-establish trust where possible, and ensure that all parties understood the importance of an evidence-based approach. Clear communication and transparency were key to moving the matter forward.
