Leinster Square W2: Retaining Wall Project

Tayross Associates Ltd. (Chartered Building Surveyors) recently acted on behalf of a freeholder in Leinster Square, W2, concerning the construction of a retaining wall at the rear of the property. This project was notifiable under Section 6(1) of the Party Wall Act, as it involved work that could potentially affect adjoining properties.
Leinster Square is home to prestigious buildings, and given the sensitive nature of the project, Tayross Associates collaborated with Robert Maycox of Maycox Surveyors to conduct a detailed schedule of condition. This assessment covered properties on the lower ground, ground, and first floor levels, both adjacent to and above the subject property, to ensure any potential impacts were thoroughly documented.
The retaining wall is being constructed to facilitate the lowering of the building owner’s garden—a common requirement in such properties where garden levels are significantly higher than the living accommodation. This type of work often necessitates careful planning and adherence to legal and structural considerations.
As part of the meticulous preparation, Tayross Associates issued a Line of Junction notice to the adjoining owners, informing them of the intention to build up to or astride the boundary line. Additionally, a Special Foundations letter was drafted due to the depth and nature of the foundations required, and permission for building astride the boundary was secured. Access arrangements were also carefully negotiated to accommodate the construction phase without infringing on neighbouring rights.
Further details were requested regarding the design, specifications, and construction methodology of the retaining wall to ensure compliance with relevant regulations and to safeguard the interests of all parties involved. These comprehensive measures helped maintain clear and communicative pathways amongst all stakeholders, thereby minimising potential disputes and facilitating a smooth execution of the project.
